Brian Jenkins has a broad Business Litigation practice.
He is a seasoned practitioner with many years of trial and tribunal experience and has appeared at all levels of the Ontario Courts.
Brian represents clients in matters extending from individual business disputes to complex contested matters, including fraud claims, share valuation proceedings, estate litigation and construction liens. He has developed particular expertise in resolving shareholder disputes and related issues in privately held companies and partnerships. In addition to appearing as trial counsel, he has experience in seeking and defending injunctions and other pre-trial remedies.
Brian acts on behalf of large and small private companies, family businesses, professionals, financial institutions, and not for profit organizations. He also acts as general counsel to a number of condominium corporations. For a number of years, Brian served as a Judge in small claims court, which affords his clients very useful perspective in strategy development.
In the area of estate litigation Brian represents individuals and family groups in matters including duties of Executors and Trustees and rights of beneficiaries, dependant adult applications, settling a variety of family disputes including those resulting from parental care, undue influence claims, Will challenges, breach of trust actions, interpretation and enforceability of Wills, the appointment or removal of trustees, passing of accounts in trusts and estates and dependant relief.
As with the other litigators at the firm, Brian supports lawyers who, from time to time, may be seeking to make a specialized referral for a client due to a conflict or for a matter outside of their area of practice.
